Terms of Service

These Terms govern your use of the CaptchaKraken API and website (the "Service"), operated by CaptchaKraken LLC, a Colorado limited liability company ("we", "us"). By creating an account, accepting an API key, or sending a request to the Service, you agree to them. If you are agreeing on behalf of a company, you represent that you may bind it.
1. The Service
CaptchaKraken provides a machine-learning inference API that interprets images of CAPTCHA challenges and returns a suggested response. We supply inference output only. We do not operate browsers on your behalf, submit responses to any third-party site, or guarantee that any output will be accepted by any CAPTCHA vendor or website.
2. Eligibility and accounts
You must be at least 18 and legally able to enter a contract. You are responsible for all activity under your account and for keeping your API keys secret. Keys are shown once at issue; we store only a hash and cannot recover a lost key. Notify us promptly at support@captchakraken.com if you believe a key has been exposed, and we will revoke it.
3. Acceptable use
You are solely responsible for how you use the output of the Service, and for ensuring that your use complies with all applicable laws and with the terms of any website or service you interact with. Automated interaction with a website may be restricted by that site's terms of use or by law in your jurisdiction. We do not advise you on, and do not warrant, the legality of any particular use.
You may not use the Service to:
- commit or facilitate fraud, identity theft, payment fraud, or any other criminal offence;
- conduct credential stuffing, account takeover, brute-force authentication, or unauthorised access to any account or system you do not own or have written permission to test;
- send spam, or create bulk accounts on a service in violation of that service's terms;
- interfere with, degrade, or overwhelm any third-party system, including denial-of-service activity;
- target government, electoral, healthcare, financial-market, or critical-infrastructure systems;
- process material that is unlawful, or that depicts child sexual abuse — such requests are reported and the account is terminated immediately;
- circumvent security controls in a manner prohibited by anti-circumvention or computer-misuse law;
- resell, sublicense, or provide the Service to third parties as your own without a written agreement with us;
- reverse engineer the Service, or use its output to train or distil a competing model.
We may suspend or terminate an account immediately, without refund of credits consumed, for a breach of this section. We may also refuse or discontinue service to anyone at our discretion.
4. Credits, payment, and taxes
The Service is prepaid. You purchase credits, and credits are drawn down as inference responses are served, at our published rates. Billing is per inference response; the number of responses a given CAPTCHA requires varies, and the published typical counts are estimates rather than guarantees.
Credits do not expire and carry no cash value except as set out in our refund policy. When your balance is insufficient, requests are refused rather than served on credit. Payments are processed by Stripe; we do not receive or store your card details. Prices exclude any applicable sales tax, VAT, or GST, which is added where required and remitted to the relevant authority.
We may change prices on 30 days' notice for future purchases. Credits already purchased are not repriced.
5. Availability
The Service is currently offered in a private beta and is provided without a service-level agreement. We do not commit to any uptime, latency, throughput, or accuracy figure. We may modify, suspend, or discontinue any part of the Service, and we will make a reasonable effort to give notice of material changes.
Responses we fail to serve are not charged. If a defect on our side causes credits to be consumed without a corresponding response, tell us and we will credit the account.
6. Your content
You retain all rights to the images and prompts you send. You grant us a limited licence to process them for the sole purpose of producing a response and operating the Service. We do not retain submitted images after a request completes, and we do not use your submissions to train models. See the privacy policy.
You represent that you have the right to submit what you send, and that doing so does not infringe anyone's rights or violate any law.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUT WILL BE ACCURATE, THAT ANY CAPTCHA WILL BE ACCEPTED, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THAT YOUR PARTICULAR USE IS LAWFUL IN YOUR JURISDICTION.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow certain exclusions; in those places the exclusions apply only to the extent permitted.
9. Indemnity
You will indemnify and hold harmless CaptchaKraken LLC and its members and agents from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
10. Termination
You may stop using the Service at any time and request a refund of unused credits under the refund policy. We may terminate for breach as described above, or for convenience on notice, in which case we will refund unused credits. Sections 3, 6 through 9, and 11 survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Colorado have exclusive jurisdiction, and both parties consent to venue there. Before filing, you agree to contact us at support@captchakraken.com and attempt to resolve the dispute informally for 30 days.
12. Changes
We may update these Terms. Material changes will be announced by email to account holders or by notice on this site at least 14 days before taking effect, and the "last updated" date above will change. Continuing to use the Service after that means you accept the revision.
